General Terms and Conditions of Use

By using the SAFRAN Avionic Support Tool website (E-ticketing) and as a user, you (hereinafter “You”) undertake to comply with these General Terms and Conditions of Use (hereinafter “GTCUs”). These GTCUs may be modified at any time by Safran Electronics & Defense without any prior notice.

Article 1 – Context in Which the Application is Made Available

The SAFRAN Avionic Support Tool website (E-ticketing) is made available to you only for your professional needs. You are responsible for your behaviour, the content You publish and your actions. Therefore, You must, in particular – but not exclusively – respect other people and their ideas, the confidential nature of information, as well as all applicable laws, regulations and standards.

Article 2 – General Obligations of the User

You are the sole person responsible for how You use this website. In this respect, neither Safran Electronics & Defense nor any SAFRAN Group Company may be held liable for how You use the SAFRAN Avionic Support Tool website (E-ticketing).

Safran Electronics & Defense and/or any SAFRAN Group Company shall not be held liable as regards the accuracy, update and exhaustiveness of the information available on the Safran Electronics & Defense application, nor any SAFRAN Group Company, nor for any damage that may stem from this.

Any information of any nature whatsoever (technical, commercial, financial or other) received from Safran Electronics & Defense, or from any SAFRAN Group Company, or from a service provider, or which You may access must be considered as confidential information and as intellectual property belonging to Safran Electronics & Defense or one of the SAFRAN Group Companies or a third party. No intellectual property rights concerning this information shall be transferred. You may in no case reproduce, copy, use or modify this information without the express agreement of Safran Electronics & Defense or of any SAFRAN Group Company concerned.

You agree to comply with the rules pertaining to exports. For any information on this subject, please contact your exports control team.

You also agree to comply with SAFRAN Group’s Charter for the Use and Security of Information and Communications Technologies.

You must not use any registered trademark or intellectual property right in any inappropriate manner, which would infringe the law and expose your company and Yourself to legal proceedings, under the law applicable before any competent court in Paris, in accordance with Article 5.

Article 3 – Contributions

Contributions are never anonymous: their authors are always identified by their surname, first name and user email address. However, the statistics on the ticket monitoring activity are anonymous.

Your contributions must be strictly professional and may not bear on any personal subject (politics, religion, lifestyle, etc.). Your contributions must not contain any offensive or defamatory statements. As your contributions must not violate the right to privacy, it is forbidden for you to disclose another user’s personal photos or information without their prior written agreement, and only if this contributes to the professional needs of Safran Electronics & Defense and/or those of a SAFRAN Group Company.

You must send an email to the administrator if you consider a given contribution to be clearly unlawful.

Moreover, in the event of any breach to all or part of these GTCUs, an administrator shall delete your contributions. In the event of any breach, Safran Electronics & Defense and/or any one of the SAFRAN Group Companies reserve the right to sue you, anywhere, under the applicable law and before any competent court of Paris, in compliance with Article 5.

Article 4. Personal Data Protection

In the legitimate interest of Safran Electronics & Defense to monitor the customer support activity, Safran Electronics & Defense (www.safran-electronics-defense.com) processes some of your personal data: your surname, first name, professional email and postal addresses, professional telephone number, company name and a connexion login.

The provision of this data is required to access the customer support service and the SAFRAN Avionic Support Tool (E-ticketing) interface.

The data we process is data You agreed to disclose to us upon creating your SAFRAN Avionic Support Tool (E-ticketing) account.

This data is kept for the lifespan of the SAFRAN Avionic Support Tool (E-ticketing) application.

The requests managed by the SAFRAN Avionic Support Tool (E-ticketing) use the customer’s email address. Thus, this information cannot be removed from the database.

The personal data is only accessible to people requiring it to perform their customer support duties and the Safran Electronics & Defense Administrators for the SAFRAN Avionic Support Tool (E-ticketing) database, who are subject to a confidentiality obligation.

Safran Electronics & Defense has set up physical, logical and organisational security measures so as to prevent any loss, corruption or disclosure of personal data to unauthorised third parties.

This data are transferred to the USA administrator (at SED Avionics USA LLC) by connecting to the users’ database located in FRANCE and is protected by suitable guarantees (signature of Binding Corporate Rules (BCR) between SED SAS and SED Avionics USA LLC for the employee personal data transferred and for the customer personal data transferred).

You have a right to access, correct, delete, limit the use and portability, as well as a right to oppose the use, which you may exercise by contacting the Personal Data Protection Officer of Safran Electronics & Defense: dpo.SED@safrangroup.com. You may also file a complaint with the French data protection authority (www.cnil.fr).

Article 5 – Applicable Law and Competent Jurisdiction

These GTCUs are governed by French Law. Any conflict arising from or connected with the formation, validity, interpretation, performance or breach and the consequences thereof, of these GTCUs which could not be solved amicably, shall be subject to the exclusive jurisdiction of the competent courts of Paris, France.
